1. Introduction & Acceptance
Welcome to MyHomeConnect.online (" MyHomeConnect ," " we ," " us ," or " our "). These Terms of Use ( Terms ) are a contract between you ( you or your ) and MyHomeConnect. They explain your rights and responsibilities when you use our websites, mobile apps, or any other online services we operate (collectively, the Platform ).
By accessing or using the Platform in any way, or by clicking an acceptance button (where provided), you're agreeing to all the Terms below, including the Arbitration and Class Action Waiver provisions. If you don't agree, please do not use the Platform.
If you're accessing or using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, “you” and “your” also refer to that entity, its officers, employees, and agents.
2. Updates to These Terms
We can change these Terms at any time. If we do, we'll let you know in one or more of these ways:
- Posting the updated Terms on our website;
- Sending you an email or message; or
- Notifying you within your account.
Unless we say otherwise, changes become effective 30 days after we post them or notify you. If you keep using the Platform after that, it means you accept the updated Terms. If you don't agree to the changes, you should stop using the Platform.
3. Our Privacy Policy & Other Policies
We care about your privacy. Our collection and use of personal information is explained in our Privacy Policy, which is part of these Terms by reference. Please review it carefully.
Certain features on the Platform (for example, any SMS/texting features) may be governed by additional terms. If those additional terms conflict with these Terms, the additional terms take precedence for those specific features.
4. The Nature of Our Service
MyHomeConnect is an online lead generation service. We help people find and connect with independent professionals ( Service Professionals or Pros ) offering various services ( Pro Services ). We do not provide, perform, or guarantee any actual Pro Services ourselves. We just connect consumers (sometimes called Customers or Consumers ) with Service Professionals who might be able to help.
- No Employment Relationship. Service Professionals are not our employees, contractors, or agents. They decide how, when, and if they provide services to you. We don't direct or control them.
- No Guarantee of Jobs. Service Professionals may get leads from us, but we cannot promise that any particular Pro will get hired, or that any Consumer will find the perfect Pro.
- No Endorsement. We may perform checks (for example, identity checks or background checks on Service Professionals), but we make no guarantees about a Service Professional's skills, qualifications, licensing, or background. Always use your own best judgment when hiring a Pro.
5. Eligibility
You must be at least 18 years old to use the Platform and must be able to form a legally binding contract. By using the Platform, you confirm you meet these requirements.
Service Professionals further confirm that they are properly licensed, insured, and qualified for the services they advertise, and that they follow all applicable laws (including privacy laws) when they use or receive any personal information from the Platform.
6. Creating an Account
You can browse parts of the Platform without creating an account. But some features require registration. When you create an account:
- You promise that all information you provide is accurate and up-to-date.
- You're responsible for safeguarding your password. Anything that happens under your account is your responsibility, so keep your password confidential and let us know right away if you suspect unauthorized use.
- You must not impersonate anyone or transfer your account to anyone else without our written permission.
7. Your Use of the Platform
As a condition of using MyHomeConnect:
- Don't violate laws: You agree to follow all local, state, and federal laws, including consumer protection, anti-discrimination, and telemarketing laws (like “Do Not Call” restrictions).
- Don't misrepresent yourself: Don't impersonate another person, use someone else's account, or lie about your identity, qualifications, or services.
- Don't harm the Platform: This includes distributing viruses, interfering with the Platform's operation, or bypassing security features.
- No spam or data harvesting: Don't collect users' personal information for unauthorized purposes, post fake job listings, or send junk mail or unsolicited marketing messages.
- No illegal or inappropriate content: Don't post anything harassing, hateful, obscene, or otherwise offensive.
- Respect intellectual property: Only post content (including photos, reviews, etc.) if you have the right to do so.
We reserve the right to remove your content or suspend/terminate your account if we believe, at our sole discretion, you've violated these Terms or engaged in misconduct.
8. User Content & License
You may post content (such as reviews, job requests, or messages) on the Platform ( User Content ). You're solely responsible for that content. By posting User Content, you're giving MyHomeConnect permission to:
- Use it in any way needed to operate or promote the Platform (worldwide, royalty-free, perpetual license).
- Modify or remove it if we find it objectionable or if it violates these Terms.
We don't claim ownership of your User Content, and you can reuse it for your own purposes. But once posted on our Platform, you grant us the above rights.
9. Fees & Payment (If Applicable)
- Lead Fees: If you're a Service Professional, MyHomeConnect may charge you fees for connecting you with potential customers or for accessing certain tools on the Platform. These fees will be explained at sign-up or in your account settings, and you agree to pay them.
- Payment Methods: You must keep a valid payment method on file. If your payment method fails, you agree we can charge any other method on file or use lawful methods to collect what you owe.
- No Guarantee: Paying MyHomeConnect for leads does not guarantee that a Consumer will hire you or pay you for your Pro Services.
- Taxes: You're responsible for any taxes on fees or income you receive (for example, as a Service Professional). We are not responsible for withholding or reporting taxes for you.
If you don't pay fees on time or if we suspect fraudulent activity, we can suspend or terminate your account.
10. Background Checks
We may (but are not required to) run background checks, identity verification, or credit checks on Service Professionals or other users, using third-party vendors. By registering as a Service Professional, you give us permission to share your personal information (like full name, address, date of birth) with our vendors for these checks. We can limit or remove your account if results are unfavorable or we suspect fraud.
However, we do not guarantee the accuracy or completeness of any background check, and we do not endorse any particular user.
11. Disputes Between Users
MyHomeConnect only connects Consumers with Service Professionals. Any contract for Pro Services is strictly between you (the Consumer) and the Service Professional. If a dispute arises between or among users (for example, a billing issue or service-quality complaint), you agree to:
- Work it out with the other party first.
- Understand that MyHomeConnect is not liable for issues arising from actual work performed (or not performed) by a Service Professional.
- If we try to help mediate informally, it's in our sole discretion. We are not required to settle disputes.
12. Intellectual Property
- MyHomeConnect Content: We or our licensors own all rights in the Platform content (like text, graphics, logos, and software), except for User Content. You can't use, copy, distribute, or create derivative works from our content without our permission.
- Feedback: If you give us suggestions or ideas on improving MyHomeConnect ( Feedback ), we can use them for any purpose, without compensating you.
13. Disclaimer of Warranties
We provide the Platform “as is” and make no guarantees that:
- It will be uninterrupted or error-free;
- All Service Professionals are safe, qualified, or licensed;
- Your Pro Services will meet specific quality standards; or
- You'll get the results you want from using the Platform.
We disclaim all warranties (express or implied) including merchantability, fitness for a particular purpose, or non-infringement. You assume all risk for using the Platform or engaging with Service Professionals you find here.
14. Limitation of Liability
To the maximum extent allowed by law, MyHomeConnect (including our employees, directors, shareholders, and agents) is not liable for:
- Indirect, incidental, special, or consequential damages, like lost profits, loss of data, or emotional distress.
- Actions or omissions of any Service Professional or Consumer, or any damage to your property, even if caused by someone you met through the Platform.
- Total damages in any case exceeding the greater of: (a) amounts paid by you to MyHomeConnect in the past 12 months, or (b) $100.
Some jurisdictions don't allow certain liability limitations, so parts of this section may not apply to you. In those places, liability is limited to the greatest extent permitted by law.
15. Your Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless MyHomeConnect, its affiliates, and their respective officers, employees, and agents, from any third-party claims, damages, losses, or expenses (including attorneys' fees) arising out of or related to:
- Your use of the Platform;
- Your User Content;
- Your breach of these Terms; or
- Any claim related to your actual or attempted provision or receipt of Pro Services (including injuries or property damage).
16. Termination
We may, at any time and for any reason, suspend or terminate your account, or block your access to the Platform, with or without notice. If we do, you may lose access to information associated with your account (including User Content).
You can also deactivate your account at any time via your account settings. However, please note we have no obligation to delete or return your User Content (like reviews) once your account is deactivated.
17. Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
- Agreement to Arbitrate: You and MyHomeConnect agree to resolve all disputes through binding arbitration, except those related to intellectual property or small claims court disputes (as explained below).
- Federal Arbitration Act: This section is governed by the Federal Arbitration Act (FAA) and is intended to be interpreted broadly.
- Process: If a dispute arises, first email us at [support@MyHomeConnect.online] to try to resolve it informally. If we can't resolve it within 30 days, either party may demand arbitration to be administered by a recognized arbitration provider (e.g., JAMS or another service).
- No Class Actions: You and MyHomeConnect each waive the right to bring or join class actions, consolidated actions, or representative actions.
- Small Claims & IP: You or MyHomeConnect may bring qualifying small claims in small claims court or disputes involving intellectual property to the courts, without arbitration.
- Opt Out: You can opt out of arbitration by sending an email titled “ARBITRATION OPT-OUT” to [support@MyHomeConnect.online] within 30 days of first agreeing to these Terms. If you opt out, neither you nor MyHomeConnect can be forced to arbitrate.
If the class action waiver is found unenforceable, then the entire arbitration section is void.
18. Governing Law & Jurisdiction
These Terms and your relationship with MyHomeConnect are governed by the laws of the State of [California], without regard to conflict-of-law rules. Any claim not subject to arbitration must be brought in [San Francisco County, CA] (or the local U.S. District Court). You waive any objections to personal jurisdiction in those courts.
19. General Provisions
- No Waiver: Our failure to enforce any right or term of these Terms is not a waiver of that right or term.
- Severability: If any part of these Terms is held invalid or unenforceable, the rest remains effective.
- Entire Agreement: These Terms (plus any other agreements explicitly referenced) are our entire agreement regarding the Platform and replace all earlier agreements.
- Force Majeure: We're not responsible for failing to fulfill obligations if caused by uncontrollable events (like natural disasters, strikes, or government acts).
